Cancellation and Refund Agreement

This Cancellation and Refund Agreement (“Agreement”) is designed to ensure fairness and timeliness to Client while protecting the Chef’s time, labor, and material investments. By booking services, including special events, weddings and weekly or recurring services, Client agrees to the following terms:

1. Events and Services

Client shall describe the type of event and the scope of services. Based upon Client’s description, Chef will provide to Client a quote that shall describe the type of event, scope of services, ingredients, date of event and any other information that is necessary to explain the total cost to Client (“Quote”). Upon receipt of the Quote, if acceptable to Client, Client will approve the Quote in writing (“Effective Date”), which shall be subject to the terms of this Agreement.

2. Deposit and Payment Terms

A non-refundable deposit of 30% of the Quote is due on the Effective date to secure the date and cover initial planning and ingredient procurement. The remaining balance of the Quote is due 72 hours before the event or service date unless otherwise stated in writing.

3. Client Cancellation

(a) Cancellations or rescheduling by Client are subject to the following fees to cover labor, purchased ingredients and administrative costs:

  • More than 30 days before the event or service date: Client forfeits deposit only.

  • 15–30 days before the event or service date: 50% of total Quote.

  • 7–14 days before the event or service date: 75% of total Quote.

  • Within 7 days of the event or service date: 100% of total Quote.

(b) For recurring weekly menu or meal prep services, cancellations made less than 48 hours before delivery will be charged at the full week’s rate to cover ingredient and labor costs.

(c) All Client cancellations must be submitted in writing.

4. Chef Cancellation

If Chef must cancel due to unforeseen circumstances (excluding Force Majeure below), any payments received will be fully refunded within 7 business days of the cancellation, and reasonable assistance will be provided to help secure an alternate provider.

5. Late Payments

Quotes unpaid after 72 hours following the event or service date will incur a 10% late fee, with an additional 1.5% per week interest until payment is received in full.

6. Ingredient and Labor Costs

Once ingredients have been purchased or staff engaged for the event, those costs are non-refundable, even if the event or service date is later cancelled.

7. Force Majeure

Chef shall not be liable for cancellations caused by events beyond control (natural disasters, power outages, illness, etc.). In such cases, deposits may be applied to a rescheduled date within 90 days, subject to availability.

8. Collections of Unpaid Quotes

If Client fails to make any payment when due, Client shall be responsible for all costs of collection incurred by Chef. Such costs include, but are not limited to, late fees, interest, reasonable attorneys’ fees, court costs, collection agency fees, administrative fees, and any other expenses arising out of or relating to the enforcement of this Agreement. Client agrees that all such costs shall be payable immediately upon demand and shall accrue in addition to any outstanding balance owed.
